The services provided by the limited liability company CHAMLOCKERS, registered with the Annecy Trade and Companies Register under number Annecy B 452 861 024, VAT number: FR17452861024, with its registered office at 118, route des Rives 74400 Chamonix Mt-Blanc, are governed by these general terms and conditions.

Article 1 – PURPOSE
These general terms and conditions of sale (hereinafter referred to as «GTC») govern the provision of automated lockers for luggage storage (hereinafter referred to as «Luggage Storage») in a secure space located at 47, Place de la Gare – 74400 CHAMONIX Mt Blanc (opposite the train station), for varying durations (hourly, daily, or multiple days).
Article 2 – LUGGAGE STORAGE CONDITIONS
2.1 The reservation and management of the Luggage Storage are handled directly at the ChamLockers premises in Chamonix Mont Blanc or via its website www.chamlockers.com. The customer must create their reservation on the ChamLockers website or use a physical terminal to access the service.
2.2 ChamLockers ensures the safekeeping and conservation of luggage deposited in the lockers during the storage period.
2.3 The Luggage Storage service offered by ChamLockers is intended for individuals over the age of 18 and is prohibited for unaccompanied minors.
2.4 The customer has exclusive use and unlimited access to their luggage locker throughout the duration of their reservation, within the opening hours: every day, from 7 am to 11 pm. Outside of these hours, no access, deposit, or retrieval will be possible.
Article 3 – AUTHORIZED AND PROHIBITED LUGGAGE
3.1 The customer agrees not to store illegal, dangerous, or perishable items in the locker. Accepted items include, within the locker’s capacity, suitcases, baskets, handbags, travel bags and similar items, keys, personal effects, documents, etc.
3.2 Luggage must be properly closed.
3.3 List of prohibited items:
- Flammable, dangerous, perishable materials, or items emitting foul odors or likely to cause damage to the luggage storage infrastructure or other stored luggage.
- All means of payment, cash, securities, negotiable instruments.
- Jewelry, precious metals, works of art.
- Official, commercial, business, manuscript, or travel documents.
- Items with a unit value generally exceeding €750.
- Luggage weighing more than 25 kg.
- Animals, plants, or any living species.
- Items prohibited by law or considered dangerous under current legislation, or items that, due to their nature or packaging, could cause damage to persons or the environment.
- Any material considered pornographic or indecent.
- Explosives, firearms, and bladed weapons.
- Any stolen or illegally held items.
- Narcotic or psychotropic drugs, and any illegal substances.
3.4 ChamLockers disclaims any responsibility in the event of the deposit of any prohibited items in the luggage lockers as per the list of prohibited items below.
3.5 ChamLockers reserves the right to open a locker in case of suspicion of illegal or dangerous contents.
Article 4 – LIABILITY
4.1 ChamLockers undertakes to take all necessary measures to secure the lockers and prevent any risk of theft or damage. The ChamLockers premises are equipped with 24/7 video surveillance. Telephone assistance (French/English) is available at the ChamLockers premises from 7 am to 11 pm. Remote unlocking of lockers by ChamLockers is possible in case of emergency.
4.2 The customer must ensure the proper locking of their locker when depositing their luggage and that nothing is left behind upon retrieval.
4.3 ChamLockers cannot be held responsible for any loss, theft, or damage to luggage due to the customer’s failure to lock the locker during deposit or temporary access, or any potential oversight upon final retrieval of their luggage. ChamLockers cannot be held responsible for any loss, theft, or damage to luggage occurring after the customer’s confirmation of final luggage retrieval or during temporary access to their locker.
4.4 The customer is responsible for the contents of their luggage and declares having taken note of the list of authorized and prohibited items for storage. ChamLockers cannot be held responsible if prohibited items or products are nonetheless stored by the customer in its premises.
4.5 The customer is responsible for selecting their locker. They must ensure that the size of their luggage corresponds to the size of the locker they have chosen before validating their reservation. Size templates are available at the ChamLockers premises, and dimensions (cm/inch) are displayed on the website chamlocker.com. They must also verify that the chosen storage duration corresponds to the opening hours.
4.6 The customer is responsible for any damage caused to the lockers and must reimburse the repair or replacement costs.
4.7 ChamLockers’ liability in case of theft, loss, or damage to items deposited in the lockers is limited to €750 (seven hundred and fifty) per locker, except in cases of gross negligence or intentional fault on its part or the exclusions of liability provided for in Article 4.2.
4.8 ChamLockers cannot, under any circumstances, be held responsible for any loss, theft, or damage to luggage left unattended by its owner after the locker is opened, as well as during transfer within its premises, or during the period of safekeeping, or when taken over by a person or service provider designated by the customer, of an «Abandoned» baggage.
Article 5 – LUGGAGE DEPOSIT AND RETRIEVAL PROCEDURE
5.1 Luggage Deposit Procedure:
When depositing, by validating the payment for their storage, the customer declares that their luggage does not fall under the non-accepted items (see list of prohibited items).
5.1.1 Reservation at ChamLockers Premises:
- The customer scans, using their mobile phone, the QR Code posted on the entrance door and enters their mobile phone number.
- They receive in return a QR Code and a validation code to allow them to unlock the entrance door and access the reservation terminal.
- The customer identifies themselves at the reservation terminal using their codes and chooses the storage duration, the size of their locker, and proceeds with the payment by Credit Card.
- After payment validation, the chosen locker opens automatically.
- After loading their luggage, the customer closes the locker door, ensuring it is properly locked, before leaving ChamLockers.
5.1.2 Online Reservation on the chamlockers.com Website
- Upon online reservation and after payment validation, the customer receives a QR Code and a validation code by email, at the address indicated during their registration.
- Upon arrival at ChamLockers, the customer unlocks the entrance door and identifies themselves at the reservation terminal using the received QR Code and validation code.
- The reserved locker opens automatically from the reservation time. No early deposit can be made.
- After loading their luggage, the customer closes the locker door, ensuring it is properly locked, before leaving ChamLockers.
5.2 Luggage Retrieval Procedure:
When retrieving their luggage, the customer is invited to confirm if the retrieval is final or not. The reservation terminal will verify that the retrieval time corresponds to the initial storage duration and will automatically unlock the locker. In case of exceeding the initial storage duration, the customer must pay the amount displayed by the reservation terminal before being able to retrieve their luggage.
The customer has a 30-second delay to retrieve their luggage. The customer must ensure that nothing is left in the locker when they leave ChamLockers. In case of difficulty, the customer must scan a QR CODE located in the ChamLockers premises to initiate the emergency procedure.
Article 6 – «ABANDONED» LUGGAGE
6.1 In the case of luggage not retrieved more than 24 hours after the expiration of the initial storage duration, it will be considered «Abandoned.»
6.2 ChamLockers will proceed to open the locker and keep the luggage in its premises for a maximum duration of 30 days. Beyond this period, it will be handed over to the competent authorities (lost and found service).
6.3 During this 30-day period, the customer can contact ChamLockers by email at contact@chamlockers.com to arrange the return of their luggage.
6.4 A flat-rate file fee of €30 as well as storage fees of €5 per day (from the day the luggage is considered «Abandoned») will be applied in addition to the tariff applied in case of delay (Article 7.5). The return of the luggage will only be made to its owner, a person, or a service provider designated by them, after full payment, by bank transfer, of the amount of the exceeded storage duration, flat-rate fees, and storage fees. The re-shipment of an «Abandoned» luggage to its owner will be at the exclusive charge of the customer. They will arrange the collection of their luggage by a person, a carrier, or a service provider of their choice. They will inform ChamLockers by email at contact@chamlockers.com at least 24 hours in advance of the re-shipment arrangements as well as the identity of the person or service provider to whom ChamLockers must hand over the luggage.
Article 7 – PRICING AND PAYMENT
7.1 The storage prices are inclusive of all taxes (VAT included), clearly displayed on the ChamLockers website and inside the premises. They are subject to change without notice. A display of the applicable rates on the day of reservation is available directly in the ChamLockers premises, on the reservation terminal, and on the website chamlockers.com.
7.2 Payment is due at the time of the locker reservation and will be made exclusively by credit card. In case of payment failure, for any reason, the reservation is not effective. Additional fees are charged in case of luggage retrieval with a delay exceeding 24 hours (Article 6-4). If a customer does not comply with the indicated retrieval times, the amount of the additional excess will be payable (Article 7.5).
7.3 The storage formulas chosen and validated by the customer are neither modifiable nor refundable, subject to Article 8 – CANCELLATION AND REFUND. The prices vary depending on the size of the locker and the chosen formula.
7.4 Any storage formula chosen and validated by the customer at the time of their reservation is due in full, even if the customer makes an early final retrieval of their luggage.
7.5 The pricing automatically applied following a delay in luggage retrieval is due, and no discount or refund (even partial) can be granted. The amount due in case of delay is calculated automatically as follows: For the initial «hourly» storage package: the excess automatically results in the billing of the following hour, up to a maximum of 5 hours from the start of the initial reservation. From the 6th hour, the «daily» storage rate is applied until the limit of the opening hours (11 pm), and for any subsequent days of delay (depending on availability), with a maximum of 3 days. For the «daily» storage package: the excess automatically results in the billing of the «daily» package for the following day within the opening hours (7 am–11 pm) and for any subsequent days of delay (up to a maximum of 3 days depending on availability). For the «Long Duration» storage package: the excess automatically results in the billing of the «daily» package for the following day within the opening hours (7 am-11 pm) for each subsequent day of delay (depending on availability), with a maximum of 3 days.
Article 8 – CANCELLATION AND REFUND
8.1 Online Reservations and Cancellations:
8.1.1 Only reservations made on the chamlockers.com website can be canceled under certain conditions. Customers can cancel their reservation up to 2 days before the scheduled start date of the storage from the «long-term reservation» button on the website www.chamlockers.com. In this case, a refund will be made. No refund will be made for cancellations made less than 2 days before the scheduled start date of the storage. The refund will be credited to the bank account used for the reservation, after deducting the flat-rate management fees, within a maximum of 15 days after the cancellation confirmation date.
8.1.2 Flat-rate management fees of €10 per locker will be applied for any cancellation.
8.2 Reservations and Cancellations at the Premises: Reservations made at the premises cannot be canceled or modified.
Article 9 – INSURANCE
9.1 ChamLockers maintains insurance covering the risks related to its activity, in accordance with legal requirements. The deposited contents are covered up to a limit of €750 per locker, excluding all items prohibited from storage (see List of Authorized and Non-Authorized Items) and subject to the customer’s compliance with these GTC, as well as the presentation of a proof of purchase.
9.2 Customers are encouraged to take out personal insurance to cover valuable items they choose to store in the lockers.
9.3 In case of a claim, the customer must immediately notify ChamLockers via the telephone assistance located in its premises, or by email, specifying their name and telephone number at: contact@ChamLockers.com
9.4 Declarations and compensation requests, accompanied by all proofs of purchase, must be sent by email to contact@chamlockers.com within a maximum of 3 days from the moment the claim is noted.
Article 10 – SECURITY AND CONFIDENTIALITY
ChamLockers implements all necessary measures to ensure the security of transactions and the confidentiality of customers’ personal data.
By accepting these General Terms and Conditions, the Customer and ChamLockers undertake to comply with the terms and conditions for the protection of personal data. ChamLockers is responsible for the processing of customers’ personal data collected in the context of the creation and management of the customer account and their navigation on the site.
ChamLockers takes appropriate measures to ensure the protection and confidentiality of the personal data it holds or processes in compliance with the provisions of the GDPR.
10.1 Necessity of Collection
The Customer communicates to the SMARTLOCKERS platform, which manages reservations, and to ChamLockers certain personal data necessary for the provision of the requested Service, namely: birth name, first name, email address, telephone number, date of birth.
If the Customer does not wish to communicate the requested information, or objects to its use by ChamLockers, it may be impossible for ChamLockers to offer the storage service.
10.2 Duration of Retention
All collected personal data is processed and retained for a period of 3 years from the retrieval of the luggage.
Upon expiration of the retention periods, the personal data is permanently deleted or anonymized.
10.3 Destination of Data
In addition to the internal services of ChamLockers, the recipients of nominative information are: SMARTLOCKERS and STRIPE
The customer’s personal data is not transmitted to third parties for commercial purposes without consent.
10.4 Customer Rights
In accordance with applicable regulations, the customer benefits from a right of access, rectification, opposition, limitation of processing, erasure, and portability of information, which they can exercise by directly addressing a request to the management by simple written request.
In case of difficulty related to the management of their personal data, the customer can file a complaint with the data controller, the data protection officer, or with the Cnil or any other competent authority.
The data controller is Mr. Denis GAVOILLE.
Article 11 – MODIFICATIONS OF THE GENERAL TERMS AND CONDITIONS OF SALE
ChamLockers reserves the right to modify these GTC at any time. The modifications will take effect immediately upon their publication on the ChamLockers website.
Article 12 – DISPUTES
12.4 In case of a dispute, the customer is invited to contact ChamLockers customer service to attempt to find an amicable solution.
12.2 In the absence of an amicable resolution, any dispute will be submitted to the competent jurisdiction in accordance with the provisions of French law.
12.3 The consumer customer can resort free of charge to a consumer mediator for the amicable resolution of the dispute in accordance with Articles L.611-1 and following of the Consumer Code.
Article 13 – RIGHT OF WITHDRAWAL (FOR CONSUMERS)
13.1 In accordance with Article L. 221-18 of the Consumer Code, the consumer has a period of 14 days to exercise their right of withdrawal from the reservation on the ChamLockers website, without having to justify reasons and with the application of the financial conditions provided for by Article 8 – CANCELLATION AND REFUND.
13.2 The withdrawal period begins from the day of the reservation.
13.3 To exercise the right of withdrawal, the consumer must notify their decision to withdraw by means of an unambiguous declaration by postal or electronic mail to the following address: contact@chamlockers.com
13.4 If the consumer requests to benefit from the storage service before the end of the 14-day withdrawal period, the consumer expressly waives their right of withdrawal for the period of storage actually used, or if the execution of the provision of the storage has begun with the consumer’s agreement, then the right of withdrawal will not apply.
Article 14 – ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS
The use of ChamLockers’ services implies full and complete acceptance of these GTC. The customer acknowledges having taken note of the GTC before any reservation and declares accepting them without reserve.
Article 15 – APPLICABLE LAW – LANGUAGE
These General Terms and Conditions are governed by French law.
All disputes that could not be resolved amicably between ChamLockers and the Customer will be submitted to the competent courts under the conditions of common law. The customer is informed that they can, in any case, resort to conventional mediation, notably with the Consumer Mediation Commission (Art. L 612-1 of the Consumer Code) or with existing sectoral mediation bodies, or to any alternative dispute resolution method in case of a dispute.
These GTC are written in French. In the event they are translated into one or more foreign languages, only the French text will be authoritative in case of a dispute.
